Rebecca Chalkley KC has successfully defended the Private Prosecution of a former accountant and financial director accused of fraud, false accounting and obtaining pecuniary advantage by deception.
Following lengthy legal argument, the District Judge quashed the summons having found that the Private Prosecutor had failed to comply with the duty of full and frank disclosure (Duty of Candour) when applying for the summons and that there had been material non-disclosure.
