The defendants had been convicted of, and sentenced for, violent disorder following widespread public disorder in the north-east of England in the wake of the Southport murders. Upon further consideration of the evidence, the CPS decided to charge them with riot as well. Paul was instructed to respond to defence applications to stay that subsequent prosecution as an abuse of process.
